By way of present petition, the petitioners are seeking quashing of FIR bearing no. 336/2023, registered at Police Station Sector-23 Dwarka, Delhi for the commission of offences punishable under Sections 380/411/34 of Indian Penal Code, 1860 (hereafter 'IPC') and all consequential proceedings arising therefrom.

Issue notice. The learned APP accepts notice on behalf of the State. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Both the petitioners and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) from Police Station 23 Dwarka, Delhi.

Brief facts of the case are that a complaint was lodged by respondent no. 2 alleging therein that petitioners have stolen 9-10 kg of plastic-covered copper wires from his factory. On the basis of said complaint, the present FIR was registered at Police Station Sector-23 Dwarka, Delhi against the petitioners. Thereafter, with the intervention of respectable members of the society, both the parties have resolved and settled their all disputes vide Memorandum of Understanding (MoU) dated 16.05.2025. 7.
On a query made by this Court, respondent no.2 who has been identified by the IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled between the parties vide MoU dated 16.05.2025 and has no objection if the present FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, this Court is of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing no. 336/2023, registered at Police Station Sector-23 Dwarka, Delhi for the commission of offences punishable under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Sections 380/411/34 of IPC and all consequential proceedings emanating therefrom are quashed.
