IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 3318/2019 MOHD. WAZIR ..... Petitioner Through Mr Shikhl Suri, Mr Shiv Kumar Suri, Ms Vinishma Kaul, Advocates.

versus STATE ..... Respondent Through Mr Sanjay Lao, ASC.

SI Amit Kumar, P.S. Kalyan Puri present.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 03.12.2019 1.

The petitioner has filed the present petition, inter alia, praying that directions be issued to the respondent to release the petitioner on parole/furlough for a period of three weeks.

2.

The learned counsel appearing for the appellant has contended that although the petitioner's request for being released on parole had been granted by an order dated 27.09.2019, he had not been released. The petitioner seeks grant of parole to attend his daughter's marriage, which is scheduled to be held on 16.12.2019.

3.

A status report has been filed, which indicates that the petitioner's assertion that his daughter's marriage is scheduled on 16.12.2019 has been verified.

4.

The nominal roll has also been filed, which indicates that the

petitioner was released on parole from 30.09.2019 to 21.10.2019, thus, the petitioner's contention that he had not been released pursuant to the order dated 27.09.2019 is erroneous.

5.

Considering that the petitioner's daughter's marriage is fixed on 16.12.2019, this Court considers it apposite to allow the present petition. The petitioner is directed to be released on parole for a period of two weeks from the date of his release, subject to his furnishing a personal bond in the sum of ₹10,000/- with two sureties of the equivalent amount to the satisfaction of the Jail Superintendent. The petitioner shall also not leave the National Capital Region. He shall provide his contact details, including the mobile number and ensure that he is reachable at all times. 6.

The petition is disposed of.

7.

The Registry is directed to communicate this order to the Jail Superintendent.
