This joint application is filed on behalf of the Plaintiff and Defendants under Order XXIII Rule 3 read with Section 151 of CPC, 1908 for decree of suit in terms of the Family Settlement Agreement dated 16.09.2024 and to place the said Settlement on record.

The suit was filed on behalf of the Plaintiff seeking rendition of accounts and partition of Nand Kishore HUF and its underlying assets, including the suit property.

During the pendency of the suit, parties have entered into a family settlement, which was reduced to writing in the form of a Memorandum of Family Settlement dated 16.09.2024, a copy of which has been appended to the application.

Some of the parties to the Family Settlement were already parties when the present suit was filed and some were subsequently impleaded vide order dated 02.04.2025 passed by the learned Joint Registrar. Amended memo of parties filed along with impleadment application is taken on record.

Court has perused the terms of the Family Settlement, which is in the form of Memorandum of Family Settlement and finds the terms to be lawful. 6.

In view of above, application is allowed, taking the Memorandum of Family Settlement dated 16.09.2024 on record and recording the settlement. 7.

Application stands disposed of.

CS(OS) 611/2024 8.

Suit is decreed in terms of the Settlement arrived at between the parties. Memorandum of Family Settlement dated 16.09.2024 will form part of the decree and terms of settlement shall bind the parties thereto. 9.

Registry is directed to draw up the decree sheet in terms of the Memorandum of Family Settlement dated 16.09.2024. 10.

Suit along with pending application stands disposed of in the aforesaid terms.
