% 12.03.2025 I.A. 5947/2025 (Application seeking exemption from furnishing indemnity bond and surety) 1.

This application has been filed by the petitioner seeking exemption from furnishing indemnity bond and surety for the like amount. 2.

Letter of Administration ('LOA') was granted in respect of the estate of petitioner's wife who had passed away, intestate, on 7th May 2023. 3.

By Order dated 6th May 2024, this Court while granting the LOA, directed that the said LOA will be granted subject to petitioner filing requisite Court Fee and furnishing requisite administrative bonds. 4.

Counsel for petitioner states that the Registry is insisting upon surety of the like amount for this purpose, which amounts to about Rs.18 Crores. 5.

In this regard, it is contended that petitioner and the deceased wife had three children, respondent nos.2 & 3, and Late Mr. Punit Pruthi. Punit Pruthi predeceased the wife of the petitioner, and was survived by respondent nos.4, 5 & 6. The legal heirs of Late Mr. Punit Pruthi have been impleaded as respondents in the petition.

It is noted in the Order dated 6th May 2024 that 'no objection affidavits' had been filed by respondent nos.2-6. In view of the fact that this petition was uncontested and that LOA was sought for the intestate succession of the estate of the wife, the Court finds merit in the application. 7.

Accordingly, it is directed that no sureties shall be required. In any event, the said sureties had not been directed by the Court on 6th May 2024. Counsel for petitioner says that Court Fee and administrative bonds have already been deposited.

In this view of the matter, the application is allowed with the above directions and disposed of.

Registry may, therefore, process the Letter of Administration within a period of two weeks.
