The Civil Revision Petition under Section 115 of the Code of Civil Procedure, 1908 ('CPC' hereinafter) has been filed on behalf of the Petitioners against the Order dated 17.07.2023 whereby the Application under Order VII Rule 11 CPC filed by the Revisionists/Defendants, has been dismissed.

However, learned counsel on behalf of the Revisionists, submits that thereafter the Suit has been dismissed by the Court under Section 11(b) of the CPC. It is, therefore, submitted that this Revision Petition has become infructuous, which should be permitted to be withdrawn with liberty to raise his defences in case any express action is taken by the Respondent.

In view of the submissions made, the Revision Petition is permitted to be withdrawn with liberty as prayed for.

The Revision Petition is disposed of accordingly along with the pending Applications.
