% 24.08.2020 Hearing has been conducted through Video Conferencing. Present Petition was filed by the Petitioner seeking directions to Respondent Nos. 2 & 3 to expedite the process of re-employment of the Petitioner to Respondent No. 3/School.

Subsequently, an Application, being CM No. 12812/2020 was filed whereby it was brought on record that vide order dated 03.02.2020 passed by the Directorate of Education, Petitioner has been re-employed as Lecturer (Commerce) in Government Sarvodya Bal Vidhalaya, Jhandewalan, with effect from 03.02.2020. Petitioner, through the said Application sought consequential benefits of re-employment.

The Application was adjourned for Mrs. Avnish Ahlawat to take instructions with respect to release of salary of the Petitioner with effect from the period he was re-employed as well as for 3rd MACP benefits, if any, due to the Petitioner.

Mrs. Avnish Ahlawat on instructions submits that salary of the Petitioner has been released. The same is acknowledged by Ms. Saahila Lamba, learned counsel for Petitioner.

In so far as the benefits of the 3rd MACP are concerned, Mrs. Avnish Ahlawat contends that the relief sought in the Application is beyond the scope of the Writ Petition.

Ms. Saahila Lamba seeks liberty to take steps in accordance with law to agitate her claim with respect to 3rd MACP benefits. Since the grievance and the relief sought by the Petitioner in the present petition stands redressed, the petition along with pending applications is disposed of, granting liberty to the Petitioner to take recourse to remedies available in law, with regard to his claim for the benefits under the 3rd MACP.
