% 25.02.2016 Present writ petition has been filed seeking a direction to the respondents to permit the petitioner to sit in the forthcoming exam for 12th Class scheduled to commence on 01st March, 2016. Petitioner also challenges the communication sent on mobile phone of petitioner's father on 02nd February, 2016 at 12:40 p.m. by respondent No.2-school Principal whereby the petitioner's admission card to sit in the Board examination was withheld. Petitioner also seeks a direction to the respondents to conduct a fresh practical exam for her.

It has been averred that petitioner is a Class 12 student of respondent No.2-School and during the academic year 2015-2016 she had remained absent due to prolonged illness which has resulted in shortage of attendance.

Learned counsel for petitioner states that father of the petitioner had handed over the medical records of the petitioner to respondent No.2School, but the same were not acknowledged. Learned counsel for respondent No.1-CBSE has handed over a communication dated 23rd February, 2016 written by the respondent No.2School to CBSE wherein it is pointed out that the petitioner's attendance in the Class 12 was about 9% only and she had not sat for any internal exam in Class 12.

Learned counsel for respondent No.1-CBSE also states that the practical exams are over and they cannot now organise the same for the petitioner once again.

In the opinion of this Court, as the petitioner has missed the practical exam and she is admittedly short of attendance, nothing can be done at this moment.
