The petitioner has filed this application for disposal of the writ petition in terms of paragraph 2 of the counter affidavit filed by respondent No.1 - Venkateshwar International School ["School"], which reads as follows:

"2. That the Respondent No.-1 school has neither created interference nor hinderance nor ever restrained the Petitioner in the discharge of his duties as portrayed by the Petitioner. In fact the Petitioner's last attendance in the Respondent No.- 1 School is 26.06.24. The Petitioner on 28.06.2024 at 2:10 pm applied for two days medical leave for 28.06.2024 & 29.06.2024 and didn't report W.P.(C) 10663/2024 Page 1 of 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

thereafter and is remaining absent from his duties. It is pertinent to mention that the Petitioner was directed to join back his duties vide email dated 29.08.2024 and letter dated 01.10.2024 sent through speed-post but to no avail. The Petitioner is welcome to resume back on his duties and he must accept it immediately, failing which the Writ Petition is liable to be dismissed." 2.

The petitioner is a regular employee of the School, having been appointed as Trained Graduate Teacher ["TGT"] Swimming in the year 2004, and subsequently designated to Head of Department, Sports. 3.

The grievance for which the petitioner approached this Court, is that he was not permitted to enter the School and discharge his duties from 27.06.2024 onwards. The contention of the School is that the petitioner has abandoned his duties.

Be that as it may, in the course of hearing, Mr. Ankit Gupta, learned counsel for the petitioner, instructed by the petitioner, who is personally present in Court, and Mr. Ankit Dwivedi, learned counsel for the School, have expressed their agreement to the following directions: (a) As suggested in paragraph 2 of the counter affidavit filed by the School, the petitioner will rejoin his duties with effect from 01.06.2025.

(b)The petitioner will regularly attend to his duties, and will be paid salary and other emoluments, as applicable, with effect from 01.06.2025, in accordance with law.

(c) The period of controversy from 27.06.2024 to 31.05.2025 will be treated as leave without pay, with continuity in service. Mr. Gupta states that the petitioner will not seek payment of salary for this period, and Mr. Dwivedi states that the School will also not initiate any disciplinary proceedings against the petitioner in W.P.(C) 10663/2024 Page 2 of 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The writ petition is taken on Board with the consent of learned counsel for the parties, and disposed of with the above directions. 6.
