The appellant has filed the present appeal impugning the order dated 08.06.2023 passed by the learned Commercial Court in OMP(COMM) No. 13/2019 captioned M/s Kakda Rolling Mills & Ors. Vs. M/s Paisalo Digital Limited. The respondent had filed the said petition under Section 34 of the Arbitration and Conciliation Act, 1996 for setting aside the Arbitral Award dated 20.10.2018.

The learned Commercial Court had found that the Arbitral Tribunal rendered the award being unilaterally appointed by the appellant without express consent of the respondents.

After some arguments, learned counsel appearing for the appellant submits that he shall take steps for constitution of a new Arbitral Tribunal to adjudicate the dispute that has arisen between the parties.
