% 07.02.2018 I.A.1495/2018 On the last two dates of hearing, this court was informed that the matter has been settled. On the perusal of the record, it is revealed that the parties have filed a joint application under Order XXIII and Rule 3 CPC. As per the said application, the parties have entered into a settlement. The terms and conditions of the settlement are stated in para 3 of the application. In terms of settlement agreement, accordingly, I allow the application. CS(COMM) 123/2016 This suit is decreed in terms of the above settlement between the parties. The terms of the settlement as stated in para 3 shall form part of the decree-sheet. Suit stands disposed. The plaintiff shall be entitled to refund of 50 percent of the court fees.
