This application has been filed jointly by the plaintiffs and the defendants, praying for a decree to be passed based on the settlement arrived at between the parties, the terms whereof have been mentioned in paragraph no.2 of the application.

The settlement has been arrived at between the parties on the following terms:
"a) The Defendants would pay the Plaintiffs a total sum of Rs.1,21,50,000/- Crores (Rupees One Crore Twenty One Lakh Fifty Thousand Only) as full and final settlement of all inter-se disputes and claims made against them by the Plaintiffs.
b) A sum of Rs. 64,60,668/- (Rupees SixtyFour Lakhs Sixty Thousand Six Hundred and Sixty-Eight) out of the aforesaid sum of Rs.
1.21 Crores (approx.) has already been paid by the Defendants to the Plaintiffs vide cheque nos. 000284 and 000285 (each bearing an amount of Rs.32,30,334/-) on 10.09.2024. The The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
same is also reflected in the order dated 10.09.2024 passed by this Hon'ble Court in Ex. P. No. 42/2023. Cheque nos. 000284 and 000285 since stand cleared (on 13.09.2024 and 12.09.2024 respectively). A copy of the order dated 10.09.2024 passed by this Hon'ble Court in Ex. P. No. 42/2023 is annexed herewith and marked as DOCUMENT -1.
c) The balance sum of Rs. 55,39,332/- (Rupees Fifty-Five Lakh Thirty-Nine Thousand Three Hundred and Thirty-Two) would be paid by the Defendants to the Plaintiffs by way of two Demand Drafts bearing Nos. 021281 and 021282 both dated 12.09.2024 for an amount of Rs. 27,69,666/- (Rupees Twenty Seven Lakhs Sixty-Nine Thousand Six Hundred and Sixty-Six) each. The said Demand Drafts would be handed over to the Plaintiff No.1 by the Defendant No.2 on the date of passing of the decree. A photocopy of the said demand drafts is annexed herewith and marked as DOCUMENT -2.
d) A sum of Rs. 1.5 lakhs (Rupees One Lakh Fifty Thousand Only) would be transferred through Real Time Gross Settlement (RTGS) in two tranches of Rs. 75,000/- (Rupees SeventyFive Thousand Only) each to Plaintiff Nos. 1 and 2 on 17.09.2024.
e) Upon receipt of the abovementioned Demand Drafts and RTGS transfers, the Plaintiffs undertake to unconditionally settle the present matter and withdraw other/remaining monetary claims against the Defendants (or Late Shri Dr. Ravi Singh). The Plaintiffs have no further claims against the Defendants (or Late Shri Dr. Ravi Singh) and also relinquish the balance amount claimed in the present suit against the Defendants (or Late Shri Dr. Ravi Singh).
f) The above terms have been mutually agreed upon between the parties without any element of force, threat, coercion or misrepresentation by any party and all parties agree not to resile The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The application is signed by the parties and is accompanied with their affidavits.

The plaintiffs are personally present in Court and so is the defendant no.2.

In terms of the said settlement, the plaintiffs state that they have received the settlement amount, including two demand drafts for a sum of Rs.27,69,666/- each in favour of the plaintiff nos.1 and 2 respectively. With the same, they have received the entire amount as has been settled between the parties.

The parties have affirmed the terms of the settlement and entire payment has been received by the plaintiffs.

I have also perused the terms of the settlement and find the same to be lawful.

Accordingly, the application is allowed.

A decree in terms of the settlement arrived at between the parties, the terms whereof have been reproduced hereinabove in paragraph no.2, is passed.

Let a decree sheet be drawn accordingly.

The next date of hearing shall stand cancelled. 12.
