% 03.12.2019 Vide the present petition, the petitioner seeks interim bail for a period of six weeks in case of FIR No. 592/15, registered at P.S. Seelampur. The present petition is filed on the ground that the wife of petitioner Smt. Zubeda Begam has been diagnosed to be suffering from Prolapsed Intra Vertebra Disc i.e. PIVD which is causing acute back ache with severe pain radiating from the back to the lower limbs of the body and for this, she has now been advised to undergo surgery on 05.12.2019. Learned APP submits that the factum of surgery of the wife of the petitioner is verified, however, the petitioner is a habitual offender and is known to have bad character in that area. Further, the petitioner is involved in 15 cases of serious nature and if interim bail is granted, he may abuse the
judicial process.
The fact remains that vide order dated 07.09.2018, the petitioner was granted interim bail on the ground of illness of his wife, the present medical conditions is more severe than the earlier one and she has now been advised to undergo surgery on 05.12.2019.
Since the petitioner has not violated terms and conditions of the interim bail granted earlier, I hereby grant three weeks interim bail from the date of release on the same terms and conditions as imposed vide order dated 07.09.2018.
