W.P.(CRL) 521/2016 and CRL.M.A. No. 2915/2016 (interim directions) Issue notice.

Mr. Rajesh Mahajan, learned Additional Standing Counsel (Criminal) accepts notice on behalf of the respondents and states that insofar as prayer clause (a) in the present writ petition is concerned, the dead body of Late Shri Vallabha Datta shall be handed over to the petitioner herein before noon tomorrow i.e. 18th of February, 2016.

Insofar as prayer clause (b) in the present writ petition is concerned, the possession of the keys of House No. 60, Gali No. 8, West Azad Nagar, Krishna Nagar, Delhi -110051 and one entry gate of Plot No. 13/25, Gali No. 3, West Azad Nagar, Krishna Nagar, Delhi -110051 shall be kept in the custody of the concerned District Magistrate, Distt. Shahdara, Delhi and shall be considered as

custodia legis.

In view of the foregoing, Mr. Abhijat, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present writ petition with liberty to approach the Court of competent jurisdiction by way of appropriate proceedings in accordance with law.

Leave and liberty granted.

The present writ petition is dismissed as withdrawn and disposed of accordingly. The pending application also stands disposed of . Copy of this order be given dasti under signature of the Court Master to counsel for the parties.
