On 16.07.2024, the learned Predecessor Bench had observed that if there is no appearance on behalf of the respondent no. 2, on the next date of hearing, this Court shall proceed to hear the matter in the absence of respondent no. 2.

No one has appeared on behalf of the respondent no. 2 even today, thus this Court proceeds to hear the matter.

The learned counsel for the petitioner states that the arrear of more than ₹20 lakhs is pending which the respondent no. 2 was required to pay to the petitioner herein. The learned counsel further requests that this Court may issue directions to the learned Trial Court that with whom the execution petitions are pending, to decide the matter expeditiously. 4.

The learned Trial Court is requested to expedite the proceedings and pass appropriate order in the execution petitions, at the earliest. At this stage, the learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to file fresh petition, in case need so arises.
