O R D E R

% 24.08.2016 Petitioners are aggrieved by the order dated 28.8.2014 wherein their application for allotment of alternate plot was rejected as the documents which were sought for from him were not delivered. This submission is refuted by learned counsel for the petitioner no.1. His submission is that all documents as were required by the Department had been submitted by him. The rejection letter dated 28.8.2014 has been premised on this count only. Record shows that the land of the petitioner forming part of village Nilothi was acquired on 12.12.1996. Predecessor of the petitioner had received compensation of Rs.53,04,385/- on 04.02.1997; another amount of compensation was paid on 20.5.1987. The application for allotment of alternate plot was filed by their predecessor within time which was on 19.9.1997. The contention of

the petitioner no.1 is that all documents including registered relinquishment deed as also death certificate of his predecessor along with ration card, three specimen signatures along with photographs and payment certificate have been submitted to the Department on 04.4.2016. The petitioner no.1 has visited the office of the respondent also on several dates but to no avail. Petitioner no.2 also submitted all documents but his case has also not been considered. Since this Court notes that the request of the petitioners has been rejected only for the reason that documents have not been furnished by them which as per the averments in the writ petition disclose otherwise. This Court is of the view that the case of the petitioners should be considered on merits. The order dated 28.8.2014 is set aside. If there are any more documents which are required by the Department, the same shall be furnished by the petitioners within an outer limit of three weeks from today. The Department will dispose of the request of the petitioners within a time bound frame.

No further orders are called for in this petition. Petition disposed of.
