Learned counsel appearing for the Petitioner, on instructions, submits that the present matter is covered by judgments of the Hon'ble Supreme Court which, as per her submission, are presently pending consideration by way of a reference before a Larger Bench. 2.

In view thereof, learned counsel seeks to withdraw the present petition at this stage, while submitting that in the event of any change in the position of law, the Petitioner may be permitted to avail such appropriate remedy as may be available in accordance with law. 3.

The liberty so sought is granted.

Accordingly, the present petition is dismissed as withdrawn.
