CM APPL. 80949/2025 (seeking permission to withdraw the present appeal) By way of the present application filed under section 24 read with section 151 of the Code of Civil Procedure 1908 ('CPC'), the appellant seeks withdrawal of the appeal in terms of the settlement that has been arrived at in mediation vide Settlement Deed dated 12.12.2025, a copy of which has been appended to the application. 2.

Mr. Pratishth Kaushal, learned counsel is present on behalf of the respondent and concurs in the submission.

By way of the present application filed under section 151 CPC, the appellant seeks release of the fixed deposit lying with the Registry of this court in pursuance of order dated 12.07.2023. 8.

Learned counsel for the respondent has no objection to the prayer being allowed.

In view of the settlement and withdrawal of the appeal, the application is allowed.

10. The Registry is directed to release the money deposited in court alongwith upto-date interest to the appellant - company through its authorised representative within 01 week of the appellant approaching the Registry after verifying the credentials.
