There is an eviction order against the petitioner herein. 2.

Pursuant to such Eviction Petition, petitioner has already filed a Revision Petition before this Court which is registered as RC. Rev. No.140/2024 and is now fixed for 27th August, 2024. 3.

However, pursuant to the decree in question, an Execution Petition has been filed by the concerned decree-holder and when such Execution Petition was taken up by the Executing Court on 5th July, 2024, it issued warrant of possession.

Such issuance of warrant of possession has been challenged on the premise that no advance notice was sent to the judgment debtor. 5.

After hearing the arguments for some time, learned counsel for the petitioner states that he may be permitted to withdraw the present application with liberty to file appropriate application seeking stay of the execution CM(M) 3100/2024 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. before the learned Revisional Court where the above revision is pending disposal.
