The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.403/2016 registered under Sections 376/376D/377/506/344/380 IPC at PS Rani Bagh. Status report not filed.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 26.11.2016. It is alleged that a marriage took place between the prosecutrix and petitioner's brother - Vicky at Arya Samaj Mandir on 22.08.2016 against the consent and willingness of the prosecutrix. prosecutrix remained in the Vicky's company from 22.08.2016 to 02.11.2016. Physical relations took place between the prosecutrix and Vicky.

On 02.11.2016 the complainant fled the spot and lodged complaint on 25.11.2016.

Main allegations are against accused Vicky. The petitioner is his brother.

No detailed particulars are on record as to when he established physical relations with the complainant. There is delay in lodging the FIR.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
