In compliance with the order dated 15th March, 2024 passed by this Court, Mr.Arun K.Jha, the Secretary, Delhi Building and Other Construction Workers Welfare Board, has appeared today through Video Conferencing. He stands discharged.

Learned counsel appearing on behalf of respondent, on instructions, submitted that the petitioner has not filed the requisite documents in order to satisfy the Board of the satisfaction of the second condition of Rule 280 of the Delhi Building And Other Construction Workers Rules, 2002 (hereinafter "the Rules") i.e. proof of fracture and plaster of right knee. On instructions, he undertakes that the concerned authority shall proceed and pass an appropriate order, after the requisite documents are furnished to the Board.

At this juncture, learned counsel appearing on behalf of petitioner, on instructions, does not press the instant writ petition on merits and seeks an innocuous prayer to approach the concerned authority for expeditious disposal of his case. For this purpose, the petitioner prays that the respondent may be directed to give the details of the requisite documents to the petitioner through e-mail and other electronic modes in order to satisfy the Board of the satisfaction of the second condition of Rule 280 of the Rules.

Heard learned counsel for the parties and perused the record. 5.

After perusal of the record, contentions made in the petition as well as the innocuous prayer made on behalf of the petitioner and the undertaking given by learned counsel for the respondent, this Court is inclined to allow the prayer of the petitioner.

Thus, the respondent is directed to provide the details of the requisite documents through e-mail and other electronic modes within two days from today. After receiving the same, the petitioner is directed to furnish the requisite documents within a week. Thereafter, the respondent-Board is directed to proceed with the matter and pass a speaking order in accordance with Rule 280 of the Rules, expeditiously, preferably within two weeks. 7.

With the aforesaid directions, the petition stands disposed of.
