CORAM:

HON'BLE MR. JUSTICE JASMEET SINGH

O R D E R

% 03.02.2026 1.

This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

"i. Issue an appropriate writ or direction or order in the nature of Mandamus thereby directing the respondent Nos.1, 2, 3 and 4 to demolish of the unauthorized construction raised by the respondent Nos.6 and 7 at the Property No.A-34, Freedom Fighter Enclave, Gate No.1, IGNOU Road, Neb Sarai, New Delhi;

ii. Issue an appropriate writ or direction or order in the nature of Mandamus thereby directing the respondent Nos. 1 and 2 for initiating disciplinary action against the erring officers of the Building Department, South Zone, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Municipal Corporation of Delhi;

iii. Issue an appropriate writ or direction or order in the nature of Mandamus thereby directing the respondent No.5 to initiate legal action against the respondent Nos.6 and 7 for electricity theft and further not to issue/install electricity connection at the Property No.A-34, Freedom Fighter Enclave, Gate No. 1, IGNOU Road, Neb Sarai, New Delhi;..."

2.

It is the case of the petitioner that respondent Nos. 1, 2, 3 and 4 are not taking any action regarding the illegal and unauthorized construction carried out at property no. A-34, Freedom Fighter Enclave, Gate No. 1, IGNOU Road, Neb Sarai, New Delhi. 3.

My attention has been drawn to the Status Report filed by the respondent No. 2 i.e. Municipal Corporation of Delhi ("MCD"), wherein it has been stated that the MCD has already taken action and demolished 3 RCC stands/panels and cut iron reinforcement bars. 4.

Since the sought action has already been taken, the prayers in the present petition stands satisfied. Presumably it is for this reason that there is nobody appearing on behalf of the petitioner. 5.

Further, the respondents are directed to ensure that no illegal and unauthorized construction takes place subsequently as well. 6.

The present petition is disposed of in the aforesaid terms along with pending applications (if any).
