The present writ petition has been filed on behalf of the Petitioner- Mr. Om Veer Singh under Article 226 of the Constitution of India read with Section 482 Cr.P.C. seeking issuance of a writ of Habeas Corpus for production of his daughter who was missing since 8th July, 2024. 3.

On 5th August, 2024 when the matter was listed, a status report dated 3rd August, 2024 was placed before the Court, as per which the missing girl claimed to be of 27 years of age and had visited the police station along with her lawyer. On 8th August, 2024 another status report was filed wherein it was confirmed that the Petitioner's daughter is in a live-in-relationship with a person, who was earlier a tenant of the Petitioner. They had thereafter moved to Aligarh, UP. The girl was contacted on video call and she and her partner were directed to appear before the Court today. 5.

At the outset, ld. Counsel for the Petitioner - who is the father of the missing girl submits that the Petitioner has suffered a medical ailment today. He has been admitted to hospital and, therefore, he is unable to appear. However, since the girl and her partner are in Court, we have interacted with them in chamber. The girl has a post graduate in Political Science from Indira Gandhi National Open University (hereinafter 'IGNOU') and is 27 years of age. She states that she has three siblings and has been in friendship with her partner since 8 years. He used to live as a tenant in one of the properties of her father in Khajuri Khas. Respondent No. 5 is an auto driver and claims to be earning well. He also states that he is interested in marrying the girl. They are presently living together and they intend to live in Khajuri Khas itself where the boy's sister and brother also live. 6.

Both the boy and the girl are clear that they wish to get married and the girl does not wish to go back to her father's place. Ld. Counsel for the Petitioner, in view of the above, wishes to withdraw the present writ petition. 7.

In view of the above, the present petition is dismissed as withdrawn. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The family of the Petitioner shall not level any threats against the girl and her partner. The numbers of the IO and beat constable be provided to the girl and her partner so that they can contact them in future, if need arises. PRATHIBA M. SINGH, J.
