% 15.03.2016 CA 941/2016 (for withdrawal of the petition) This is an application seeking, in effect, withdrawal of the captioned petition.

The learned counsel for the applicant / petitioner says that leave was sought to withdraw the aforementioned petition as the legal notice dated 11.11.2013 was not served on the registered office of the non-applicant/respondent.

Issue notice to the non-applicant/respondent. Mr. Rajnish Kumar accepts notice on behalf of the nonapplicant/respondent. Mr. Rajnish Kumar says that he does not wish to file a reply to the captioned application. The learned counsel further states that he CO.PET. 197/2014

has no objection to the application being allowed. The applicant/petitioner has sought leave to withdraw with liberty to file a fresh petition.

Accordingly, the application is allowed.

The accompanying petition will stand dismissed as withdrawn with liberty to the applicant/petitioner to file a fresh petition; albeit in accordance with law.

CO.PET. 197/2014 In view of the order passed in CA 941/2016, no further orders are called for in the captioned petition.
