O R D E R
% 30.04.2015 Learned APP for the State submits that pursuant to order of Metropolitan Magistrate, Rohini Courts, passed under Section 156(3) Cr.P.C., present FIR was registered.
Complainant has alleged in the FIR that he had applied for sanction of loan from ICICI Bank, Jhandewalan Branch in the month of October, 2008. Subsequently, two persons visited his house and represented that they were executives of the said bank and took certain documents and five cheques bearing nos. 945619-23 towards security from the complainant.
Out of these five cheques, the cheques bearing nos. 945620 and 945622 were encashed fraudulently. On enquires, it was revealed that the cheques were encashed in the accounts of Shri
Naveen Kumar and Jashpal Singh.
It is submitted by the learned APP that in the disclosure statement of Naveen Kumar and Jashpal Singh, it has come that it was the petitioner who had filled up the cheques which indicates that he connived with Naveen Kumar and Jashpal Singh in duping the complainant. Learned counsel for the petitioner submits that handwriting and specimen signatures of petitioner have already been taken by the Investigating Officer. It is further submitted that only disclosure statement of co-accused is there against the petitioner which has not led to any recovery from the petitioner and is inadmissible. There is nothing to show that petitioner had received the encashed amount. It is further contended that Naveen Kumar has already been released on regular bail; whereas Jashpal Singh has been granted anticipatory bail.
Keeping in mind totality of the facts and circumstances of this case, it is ordered that in case of arrest petitioner be released on bail subject to his furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/Station House Officer.
Bail application is disposed of in the above terms.
