% 16.02.2018 Petitioner claims to be squatting near U.P. Bhawan Sardar Patel Road, Malcha Marg, Chanakyapuri, New Delhi. The grievance of the petitioner is that the petitioner was threatened by the official of the respondent on 06.02.2018 and was asked to vacate the area in question.
Counsels for the respondents, who enter appearance on an advance copy, submit that the area in question is a 'no hawking, no vending zone'. Additionally, a complaint was received by the Health Department as the petitioner was selling food and was creating unhygienic conditions in and around the area in question.
Counsel for the petitioner submits that the petitioner shall sell packaged food and would ensure that the area is kept neat and tidy. At this stage, Mr. Sahoo, counsel for the petitioner does not wish to press this petition and submits that the petitioner will approach the TVC as and when
it becomes functional and make an application with all supporting documents. Accordingly, the writ petition is dismissed as not pressed with the liberty as prayed. We make it clear that we have not expressed any opinion on the merits of the case.
