The Appellant was the employer of the Respondent, who was drawing a salary of Rs. 8,700/- during the relevant period of his employment. It is the case of the Appellant that the Respondent has been paid a sum of Rs. 47,053/- as an excess payment, which is now sought to be recovered through this Appeal.

Admittedly, the Respondent retired in the year 2017 and is already in the evening of his life.

In view of the judgment passed by the Supreme Court in State of Punjab vs. Rafiq Masih (2015) 4 SCC 334, this Bench is not inclined to interfere with the judgment passed by the learned Single Judge.
