An application under Section 439 read with Section 482 Cr.P.C has been filed on behalf of the petitioner for grant of Interim Bail for four weeks on account of the surgery of his mother which has now been fixed for 13.08.2024.

It is submitted that the mother of the petitioner is suffering from Coronary Artery disease and shortness of breath for which she has been advised to undergo the surgery. The application is supported with the medical documents of the mother of the petitioner. 3.

Learned Prosecutor submits that since the documents provided were only the photocopies, the same could not be verified. However, considering the imminent situation, the petition may be admitted to bail subject to the verification of medical record.

In view of the submissions made, the petitioner be released on interim bail for four weeks from the date of his release upon his furnishing a personal bond in the sum of Rs.25,000/- and one surety of the like amount, to be produced before the trial court for acceptance of the bail bond to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. satisfaction of the learned Trial Court, and further subject to the following conditions:- a) Applicant shall not leave Delhi/NCR without prior permission of the Court;

b) Applicant shall appear before the Court as and when the matter is taken up for hearing;

c) Applicant shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;

d) Applicant shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi. e) Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. f) Applicant shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner. 5.

Upon expiry of period of one month, as stated above, the applicant shall surrender before the concerned Jail Superintendent. 6.

The State may verify the date of surgery and medical records in the interim and in case, they are not found genuine, may seek cancellation of Interim Bail.

The application stands disposed of.
