O R D E R

% 07.05.2018 It is submitted that petitioners (accused) and respondent no. 2 (complainant) have settled their disputes amicably for `5,00,000/-; therefore, FIR no. 209/2010 under Sections 384/34 IPC read with Section 120-B IPC registered at police station Punjabi Bagh and the consequent proceedings emanating therefrom may be quashed. Memorandum of Understanding dated 27th July, 2016 is on record at pages 101 to 105. Respondent no. 2 is present in Court along with his counsel and has been identified by SI Amit Kumar of police station Punjabi Bagh.

Respondent no. 2 admits having

settled the matter with petitioner of his own free will, voluntarily and without any undue force, pressure or coercion, inasmuch as has received the entire settled amount vide three demand drafts, photocopies whereof have been placed on record. Respondent no. 2 submits that he has no objection in case FIR is quashed against the petitioners.

Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, FIR no. 209/2010 under Sections 384/34 IPC read with Section 120-B IPC registered at police station Punjabi Bagh and the consequent proceedings emanating therefrom are quashed.
