A Petition under Section 528 of BSS of 2024 has been filed on behalf of the petitioner for quashing of the Order dated 25.08.2023 vide which the petitioner has been summoned by the learned CMM in FIR No.21/2012. 4.

It is further submitted that because of the medical condition, the petitioner is not in a position to appear in the Court, though the learned CMM vide Order dated 25.08.2023 has directed the personal appearance of the petitioner.

After some submissions, learned Counsel seeks permission to withdraw the present petition with liberty to challenge the Order in accordance with law before he appropriate Forum. 6.

The present petition is permitted to be withdrawn with liberty as prayed for.

In so far as the presence of the petitioner before the learned CMM is concerned, he is at liberty to move an application for exemption from personal appearance, which may be considered by learned CMM, if justified by the circumstances.

The petition is accordingly disposed of.
