The instant application under Section 439 of the Code of the Criminal Procedure, 1973 ('Cr.P.C.') has been filed on behalf of applicant seeking grant of interim bail for a period of four weeks in case bearing FIR no. 887/2022, registered at Police Station Narela Industrial Area, Delhi for offence punishable under Sections 302/174A/34 of the Indian Penal Code, 1860 ('IPC').

Learned counsel for the applicant argues that applicant herein seeks interim bail on the ground that he has to arrange money for the surgery of stone in Gall Bladder of his wife and to look after her post-surgery. It is stated that the surgery of the wife of applicant is scheduled for 23.01.2024. 3.
Learned ASC for the State submits that the I.O. has verified the documents related to surgery of the applicant‟s wife. 4.
This Court has heard arguments advanced by both the parties and has perused the material on record.

In the present case, the documents related to surgery that the applicant‟s wife has to undergo surgery, have been verified by the State. 6.
In view of the submissions made before this Court, and considering the overall facts the circumstances of the case, this Court finds it a fit case for grant of interim bail for a period of two weeks to the applicant commencing from 22.01.2024, on his furnishing a personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety of the like amount to the satisfaction of the Trial Court/Successor Court/Link Court/Duty Judge, on the following terms and conditions: i. The applicant shall remain available on the mobile numbers, shared by him with the Investigating Officer, which shall be kept operational at all times.
ii. The applicant shall not indulge in any act which may prejudice either the trial or influence the prosecution witnesses. iii. The applicant shall duly surrender before the concerned Superintendent Jail on the expiry of interim bail. iv. The period of two weeks shall be counted from the actual date of release 7.
Accordingly, the present application seeking interim bail stands disposed of.

It is also clarified that, no extension of interim bail will be granted to the applicant.
