% 30.05.2017 This is an application filed on behalf of the petitioner seeking grant of anticipatory bail in case FIR No.53/2017, under Sections 354/354B/34 IPC and Section 12 POCSO Act, registered at Police Station- Khajuri Khas. Learned counsel for the petitioner submits that the petitioner has joined the investigation and that the petitioner is not required for any custodial investigation. He further submits that the allegations alleged in the FIR are totally false and further the petitioner is ready to abide by any other condition, if any, imposed by this Court and prays that the petitioner be granted anticipatory bail.
On the other hand, learned APP for the State vehemently opposes the bail application, while submitting that the case qua against the present petitioner is to the extent of Section 354 IPC. She, however, admits the
factum of joining the investigation by the petitioner. Heard.
Perused.
Looking into the facts and circumstances of the case, the petitioner is directed to join the investigation and in the event of his arrest, the petitioner be released on anticipatory bail on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned with the condition that he shall not influence the prosecution witnesses; he shall not tamper the prosecution evidence; he shall not visit the house of the complainant; he shall not contact/communicate, threaten or coerce the complainant or any of her family member; he shall not indulge in any illegal activities; he shall not leave India without prior permission of the concerned Court.
The present bail application is allowed and disposed of accordingly. However, this order shall not affect the merit of the case. Copy of this order be given dasti.
