CRL.M.C. 6035/2024 1.

This petition has been filed for quashing of the FIR 0348/2021, under Sections 498A/406 IPC registered at Hauz Khas, on the ground of settlement arrived at between the parties dated 27th November, 2021, which is on record of this Court.

As per the settlement, pursuant to marital discord, parties have agreed to co-parent the two children; details of the custody and visitation have been outlined in the settlement agreement.

both confirmed the above.

Respondent no.2 has no objection to the quashing of the said FIR. 5.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 0348/2021 under Sections 498A/406 IPC registered at PS Hauz Khas and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 7.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
