By way of present revision petition, the petitioner seeks to assail the order dated 24.05.2023 passed by the Ld. Family Court, North East District, Karkardooma Court, Delhi in MT No. 493/2021 and 256/2022. 2.

A perusal of the petition would show that respondents No.1 being the complainant had preferred the petition under Section 125 Cr.P.C. seeking award of interim maintenance for herself as well as their minor child. The Family Court had passed the order dated 01.03.2023 whereby the present petitioner was directed to pay interim maintenance @ Rs.10,000/- each to both of the respondents.

Learned counsel for the petitioner submits that petitioner never assailed the said order and has continued paying the said maintenance without any default. made the order dated 01.03.2023 absolute. Considering that the initial order has remained unchallenged till date and impugned order came to be passed after filing of the response as well as income affidavit, I do not find any ground to entertain present petition. Consequently, the present petition is dismissed alongwith pending applications.

Needless to state that in case at the time of disposal of the maintenance petition, the Family Court, on consideration of material on record as well as income affidavits filed by the parties, comes to the conclusion that the respondents are entitled for lesser or higher maintenance, the Family Court would be at liberty to grant adjustment of the arrears either way.
