Petitioner herein seeks issuance of a writ in the nature of Mandamus directing the respondent and/or the Sentence Review Board (SRB) to consider the petitioner's case and grant premature release in criminal case arising out of FIR No. 175/2012, under Sections 376/506 IPC, Police Station Chhawla.

Succinctly, the case set up by the petitioner is as under (relevant paras from petition) :- "6. That the petitioner has suffered a lot during his long and continuous incarceration of about thirteen (13) years and with remission about fourteen (14) years. The jail authorities carried out some formalities last year in regards to forwarding the name of the petitioner for the Sentence Review Board (SRB) but seemingly, the same was not considered for the reasons best known to the respondent. The family of the petitioner consists of his wife and daughter. The petitioner has proven that he is on the path of reformation. The reformative aspect of the Indian Legal System may kindly be considered at the time of deciding the plea of the petitioner. The petitioner hails from the poorest segment of society.

7. That the family of the petitioner is in a completely dilapidated state due to his incarceration as there is no one to take care of the family of petitioner since he is the sole bread winner of his family.

8. That the petitioner has consistently shown good conduct during his incarceration. The name of the petitioner was sent once and it was rejected however, it was not sent again to the Sentence Review Board despite passage of time."

Mr. Yasir Rauf Ansari, learned ASC (Crl), appears for respondent/state on advance service. He submits that whenever the next meeting of the Sentence Review Board (SRB) is convened, the petitioner's case shall be considered by the Board.

In view of the aforesaid candid statement, the instant petition is disposed of with a direction that all appropriate steps shall be taken by the competent authority of the State to consider the case of the petitioner in the forthcoming meeting Sentence Review Board (SRB) and take a decision either way, in accordance with law.

Let the copy of this order be sent to the Jail Superintendent concerned for information and compliance.
