The present application has been filed under Order XXIII Rule 1(3) of the Code of Civil Procedure, 1908 ("CPC") for withdrawal of the present suit.

Learned counsel appearing for the plaintiff submits that while the present proceedings are pending adjudication, the parties hereto are also engaged in settlement negotiations outside the purview of this Court. 3.

It is submitted that there is a bonafide possibility of arriving at an amicable settlement between them. In view thereof, the plaintiff no longer wishes to press or pursue the present proceedings. 4.

Accordingly, the present application has been filed. 5.

granted liberty to withdraw the present suit, with liberty to file a fresh suit on the same cause of action, in case any grievance still survives or the settlement between the parties does not take place. 6.
