1. Learned counsel for the appellant submits that since the suit out of which the impugned order arises stands dismissed for non-prosecution by the respondent/plaintiff, he has instructions not to press the appeal any further.

He, however, prays that the appellant may be granted liberty to revive the appeal in case the suit is restored at any stage.

2. In the light of the aforesaid, while disposing of the appeal as not pressed, we grant liberty to the appellant to seek revival of the present appeal in case the suit being CS(OS) 373/2019 is revived at the behest of the respondents.
