O R D E R

% 13.12.2019 Vide the present petition, the petitioner seeks direction thereby to quash / set aside the lookout circular issued against the petitioner by the respondents.

Or in the alternate;

Direct the respondents to withdraw the look out circular against the petitioner.

Quash / set aside the letter dated 26.09.2019 issued by the respondent no. 1 whereby the request of the petitioner for withdrawal of the look out circular has been rejected.

In the status report produced in court (to be taken on record), it is submitted that petitioner is well connected with Mr. Parasmal Lodha and

was interrogated during the period of Demonetisation by the official of Enforcement Directorate/R-1. There are references made to Mr. Jamil Saidi, in the statements received from Income Tax Department during the course of search of Sh. Ratul Puri and his companies in April, 2019. The investigation into cash transactions and accommodation entries is in progress.

It is admitted fact that the petitioner's statements were recorded on 27.06.2019, 28.06.2019 and 26.06.2019 after which he requested for time to undergo treatment for his stated illness and requested to rejoin the investigation on 01.07.2019. Accordingly, his request was accepted by the respondent no.1 department. However, he did not appear for recording his statements on 01.07.2019 but appeared on 03.07.2019, 04.07.2019 and 08.07.2019.

Keeping in view the averments made in para 11 of the status report, I hereby direct the respondent to record the statement of the petitioner, if required within ten days from today.

It is made clear that if the petitioner is not required for custodial interrogation, then the respondent is directed to suspend the look out circular against the petitioner.

In view of above direction, the petition is disposed of. Pending application also stands disposed of.
