% 21.09.2016 C.M. No.34556/2016 (for restoration) This an application seeking restoration of the petition which had been dismissed in default, non-prosecution as also on merits. Counsel for the petitioner is aggrieved only by that part of the order wherein it has been recorded that the petitioner stands dismissed on merits as well. His submission is that he has a good case on merits.

Accordingly that part of the order is set aside. While disposing of the petition on 17.8.2016, this Court had noted that the order impugned before this Court had been passed by the Revenue Assistant against which an appeal lies before the Deputy Commissioner.

No further orders are called for.

Application disposed of.
