The petition is for directions to the respondents not to forcefully dispossess the petitioner of the property bearing no. M-488, J.J. Colony, MBlock, Shakurpur, Delhi-110034. 2.

The petitioner is the son of respondent no. 3-senior citizen, who had approached the Maintenance Tribunal (Tribunal) under the Maintenance and Welfare of Senior Citizens Act, 2007, alleging that the petitioner and his family were harassing her and restraining her from entering the residential property in question. The Tribunal, vide order dated 11.09.2015, had directed that respondent no. 3 shall occupy the first floor of the property in question and recover rentals from the other two floors. into the property.

The petitioner had filed W.P. (C) 9717/2015 assailing the said order before this Court, and the same was dismissed vide order dated 13.10.2015. The Court observed that the order of the Maintenance Tribunal nowhere directs the petitioner to vacate the entire property, and that in case attempts are made to forcefully evict the petitioner from the property entirely, he would have remedies thereagainst.

The petitioner has annexed Notice dated 30.03.2024 issued by the Station House Officer, Subhash Place, whereby, he has been directed to vacate the first floor of the property in question and handover its possession to respondent no. 3. Further, he has been directed to furnish any Court order staying the operation of the order passed by the Maintenance Tribunal, failing which, the same would be executed.

A perusal of the material on record indicates that the petitioner has been directed to vacate only the first floor of the property in terms of the directions of the Maintenance Tribunal. In case any attempt to forcefully evict the petitioner from the entire property, if is made, without following due process of law, he shall be entitled to appropriate remedies as per law. 6.

It appears that there exists pending litigation between the parties. They shall abide by the directions to be passed by the concerned Court. 7.

In view of the aforesaid, finding no justification to keep this petition pending, the same stands disposed of.

All rights and contentions are left open.
