The present writ petition has been filed by the petitioner praying for quashing of FIR No.1578/2015 under Section 363 IPC, PS Narela, Delhi as well as the criminal proceedings emanating therefrom. 2.
Status report on behalf of the State has been filed. Along with the status report, copy of the statement under Section 164 Cr.P.C. made by Ms.K (name withheld to conceal her identity), the girl who was allegedly kidnapped has also been enclosed. As per the said statement Ms.K left home on 14th December, 2015 informing her elder sister that she was going to her Aunt's (Mausi) house. Thereafter, she met Rahul, who is her friend and she accompanied him. She returned home on 19th February, 2016. She has specifically stated that she had left home of her own sweet will and was not induced by Rahul nor any Galat Kaam has been done with her. W.P.(CRL) 542/2016

Today the complainant/father of Ms.K is also present in the Court and he states that since his daughter has left the house of her own and returned of her own, he does not want to continue with the proceedings and the FIR No.1578/2015 under Section 363 IPC, PS Narela, Delhi registered at his behest may be quashed.

Since the complainant himself does not want to continue criminal proceedings on coming to know that his daughter Ms.K aged about 17 years was not kidnapped by the petitioner and that she has left the house of her own sweet will and no purpose would be served in continuing the proceedings against the petitioner.

Accordingly, the petition is allowed and FIR No.1578/2015 under Section 363 IPC, PS Narela, Delhi and consequential proceedings arising therefrom are hereby quashed.
