By way of present petition, filed under Section 482 of the Code of Criminal Procedure, 1973 (hereafter „Cr.P.C.‟), the petitioner prays for quashing of FIR bearing no. 565/2017 dated 28.12.2017 registered at Police Station Kalkaji, Delhi for the offences punishable under Sections 420/471/468 of the Indian Penal Code, 1860 (hereafter „IPC‟). 2.

Brief facts of the present case are that the petitioner and respondent no. 2 are the real siblings and living peacefully and harmoniously in same house. However, respondent no. 2 had lodged a complaint against the present petitioner, which had culminated into the present FIR. 3.

On a query made by this Court, respondent no. 2 who has been identified by the IO, categorically stated that he has entered into compromise with the petitioner out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled between the parties vide Memorandum of Understanding (MOU) dated 03.12.2022. It is stated that an amended MOU has also been filed by the parties, however, the same is not on record. A hardcopy of the same has been handed over to the Court, which is taken on record.

Today, the complainant who is present in Court states that he has received the entire amount due and has no objection if the present FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, this Court is of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 565/2017 dated 28.12.2017 registered at Police Station Kalkaji, Delhi for the offences punishable under Sections 420/471/468 of the IPC and all the consequential proceedings emanating therefrom are quashed.
