This application under Order XXIII Rule 1 CPC has been filed by the Plaintiff seeking permission to withdraw the present suit with liberty to file a fresh suit in Iran.

Permission for withdrawal of the suit is granted. However, it is always open for the Plaintiff to institute a suit in Iran provided the laws in Iran permit filing of the suit therein after withdrawal of the suit in India. 3.

It is made clear that this Court has not granted any liberty to the Plaintiff to file a suit in Iran 4.

The suit is disposed of as withdrawn, along with pending application(s), if any.
