This is a joint application filed by the parties seeking to withdraw the present petition.

Learned counsel for the petitioner states that the Petitioner, along with Respondents Nos. 2, 3, 4, and 5 have entered into a settlement agreement dated 09.12.2024. He states that Respondents Nos. 3, 4, and 5 have already filed their no-objection affidavits confirming the validity of the Will dated 18.11.2015. He states that however, objections were filed by Respondent No. 2.

two immovable properties and to execute other necessary documents for liquidating the movable assets of the deceased, Late Sh. Sudarshan Lal Ahuja.

The Petitioner and the Respondents Nos. 2 and 3 are present in person.

The Petitioner and the Respondents undertake to this Court that they will abide by the terms of the settlement agreement dated 09.12.2024. 6.

The statements and undertaking given by petitioner and the Respondents Nos. 2 and 3 as well as learned counsels appearing for Respondent Nos. 4 and 5 are accepted by this Court and parties are held bound by the same.

Learned counsel for the petitioner states that in terms of the settlement agreement dated 09.12.2024, a banker's cheque for a sum of Rs.25 lacs towards part payment has been handed over to the Respondent No. 2, who is present in Court. Respondent no. 2 has acknowledged the receipt. 8.

Accordingly, the present petition along with pending applications, if any, is dismissed as withdrawn.

The date already fixed i.e. 24.01.2025, stands cancelled. 10.
