O R D E R

% 13.03.2018 Vide the present petition, the petitioner has sought a direction to the respondent no.2, to issue a „No Objection Certificate‟ (NOC) to the petitioner to the effect that his land is not a part of any acquisition proceedings under the Land Acquisition Act, 1894. The petitioner has further sought a direction to the respondent no.3 to register his sale deed after issuance of the said NOC.

Today, learned counsel for the petitioner submits that in view of a latest decision dated 06.09.2017 of this Court in W.P.(C)No.7242/2017, the petitioner seeks to approach the respondent no.3 without awaiting for a NOC from respondent no.2. He therefore prays that he may be granted leave to withdraw the present petition in order to approach respondent no.3 with a request to register his sale deed.

Leave as prayed for is granted with liberty to the Petitioner to

approach the Respondent no.3 for registration of his sale deed. It is, however, made clear that the Court has not expressed any opinion on the right or entitlement of the petitioner to get the sale deed registered without a NOC. Needless to state that, in case, the Petitioner is aggrieved by any order passed by respondent no.3, he would be free to take legal recourse, on all available grounds including the grounds taken in the present petition.

The writ petition is dismissed as withdrawn with the aforesaid liberty.
