Further to the order dated 03.05.2023, Mr. Ankur Chhibber, learned counsel for the plaintiffs, states that the suit was filed by plaintiff No. 2, as the next friend of her father, who was arrayed as plaintiff No. 1, for protection of his assets and interests during his lifetime. Plaintiff No. 1 passed away on 09.03.2023.

In this view of the matter, Mr. Chhibber seeks permission to withdraw the suit, with liberty to plaintiff No. 2 to file independent proceedings for her own share in her late father's estate, if so advised. 4.

Learned counsel for the defendants do not have any objection to the request in these terms.

The suit is dismissed as withdrawn, with liberty as stated above. All pending applications also stand disposed of.
