Learned Counsel for the Petitioner states that he has instructions from the Petitioner that the Petitioner would approach the MSME Council under the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006, pursuing his remedies. He, therefore, seeks permission to withdraw the present petition with liberty to avail the remedies as available to him under law.

Permission and liberty, as sought for, is granted. 3.

Learned Counsel for the Petitioner also states that the performance Bank Guarantee is valid till 30.09.2025, which is twice the amount of the claim, and therefore, the Respondent being an instrumentality of the State, should not invoke the Bank Guarantee. The statement is taken on record. 4.
