After some arguments on 20.02.2024, the learned counsel appearing for the parties had taken time, to explore the possibility to resolve their disputes amicably. Further proceedings were, accordingly, adjourned on 20.02.2024 and the matter has been listed today. 2.

The learned counsel for the parties state that they have since resolved their disputes amicably, the respondent will pay a total sum of ₹42.39 lakhs. The said amount would be paid within a period of four weeks from today. It is also agreed that in the event, the amount is not paid within the aforesaid period, the appellant would be at liberty to apply for restoration of the present appeal, which would then be disposed of on merits. 3.

The respondent would also be at liberty to withdraw the demand draft of a sum of ₹2.39 lakhs furnished before the Trial Court.
