W.P.(C) 9397/2016 Learned counsel for the petitioner during the course of hearing has drawn our attention to order dated 9th January, 2013 passed in writ petition No.6944/2012 whereby order dated 9th December, 2011 passed by the Principal Bench of Central Administrative Tribunal was set aside with an order of remand to decide OA No.2026/2010 afresh. This order also refers to the prayer for parity of pay-scale with the corresponding posts is the non-secretarial service. The petitioner also refers to the order dated 2nd April, 2007 passed in OA No.1093/2006.
He submits that the tribunal has examined the issue and question of the cadre review which was implemented vide order 30th June, 2014, and whether the review can be given retrospective effect from 1st January, 1996 but has not gone into the question of parity of pay on the principle of equal pay for equal work. After some hearing learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach the tribunal by way of a review application. If any review application is filed, the tribunal will bestow consideration as per law. Petition is dismissed as withdrawn with liberty as prayed for.
