O.M.P.(MISC.)(COMM.) 616/2023 Pursuant to court notice issued vide last order dated 05.02.2024, learned counsel has entered appearance on behalf of the respondents via video-conferencing. Counsel submits that the respondents have no objection to the extension of the mandate of the learned Sole Arbitrator as prayed-for by way of the present petition. 2.

The record shows that the learned Sole Arbitrator was appointed vide order dated 19.09.2019 and the last extension of the mandate was granted vide order dated 28.02.2023 in OMP (MISC.) (COMM) No.58/2023 for a period of 06 months, which mandate has expired on 31.08.2023.

Ms. Riddhi Jain, learned counsel appearing for the petitioners submits that the arbitral proceedings could not go-on for a very long time since the respondents did not co-operate and have subsequently withdrawn their claims, leaving only the petitioners' counter-claims surviving before the learned Sole Arbitrator. 4.

The matter is now stated to be at the stage of deposition on behalf of the witnesses for the counter-claimants/petitioners. 5.

Considering the circumstances of the case, the petition is allowed, thereby extending the mandate of the learned Sole Arbitrator for a further period of 06 months from today, further observing that any proceedings undertaken after expiration of the previous mandate on 31.08.2023, also stand validated and regularised. 6.

The petition is disposed-of in the above terms, with a request to the learned Sole Arbitrator to conclude the proceedings within the extended period of the mandate.
