The present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C‟) has been filed on behalf of petitioner seeking quashing of FIR bearing no. 915/2015, registered at Police Station Tilak Nagar, Delhi for offence punishable under Section 135 of Electricity Act, 2003 and all other proceedings emanating therefrom.

Issue notice. Mr. Anand V. Khatri, learned ASC accepts notice on behalf of State.

Petitioner is present before this Court and has been identified by his counsel Mr. Kamal Jindal and Investigating Officer (IO) SI Naresh Kumar from Police Station Tilak Nagar, Delhi.

On the complaint of respondent no. 2/BSES, the present FIR bearing no. 915/2015 was registered against the petitioner for the offence punishable under Section 135 of Electricity Act. It is stated that during the pendency of the case, petitioner had settled the matter with BSES Rajdhani Power Ltd. and settled amount was deposited vide Invoice dated 03.02.2020 in case I.D. No. RJ261114WB149.

On a query made by this Court, respondent no. 2/BSES has categorically stated the petitioner had settled the matter with BSES Rajdhani Power Ltd. and settled amount was deposited vide Invoice dated 03.02.2020 in case I.D. No. RJ261114WB149 and has no objection, if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the above mentioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 7.

Accordingly, FIR bearing no. 915/2015, registered at Police Station Tilak Nagar, Delhi for offence punishable under Section 135 of Electricity Act and all consequential proceedings emanating therefrom are quashed. 8.

In view of the above, the present petition stands disposed of. 9.
